How Litigation Funding Works

Overview

Litigation funding, sometimes referred to as external funding or third-party funding, involves a funder paying a claimant’s costs of bringing a legal claim, in exchange for a share of any settlement or judgment amount. It enables claimants to seek access to justice without bearing the upfront costs and risks of litigation.

Litigation funding provided by LLS

For litigation funding provided by LLS, once we assess and approve a claim, we cover the agreed case-related costs and pay the lawyers’ invoices directly. If the case succeeds, we receive an agreed return from the proceeds. If it doesn’t, the claimant owes nothing – we bear the loss.

Indemnity to claimants

LLS funding also includes an indemnity to claimants if they are required to pay any of the other side’s costs, further reducing the risks to a claimant in taking legal action.

Access to justice

This model ensures fair access to the legal system, levels the playing field, and allows meritorious claims to proceed regardless of a claimant’s financial position.  It also means that instead of spending money on legal fees, sometimes for multiple years before a case resolves, claimants get to use those funds for their own purposes such as to grow their business while the claim remains on foot.
