In 2021 Litigation Lending Services (LLS), in partnership with Shine Lawyers, launched legal action against the Commonwealth Government on behalf of the Stolen Generations of the Northern Territory, who were forcibly removed from their families as children.

Although a formal apology has been made, the Commonwealth had refused to pay compensation to these members of the Stolen Generation, despite their own recommendation to do so. All other states with similar policies have paid compensation to those affected.

Subsequently, in August 2021, the Commonwealth launched its redress scheme, providing monetary compensation for Stolen Generation survivors in the Northern Territory, Australian Capital Territory and Jervis Bay Territory who were removed from their families.

LLS is proud to announce the matter survived beyond the redress scheme and has now been settled with the Commonwealth pending final approval by the Supreme Court. Once approved, the living members of the Stolen Generation will retain access to the Commonwealth’s Territories Stolen Generations Redress Scheme with separate and additional compensation of $50.45 million now available for approximately 1,700 family members and deceased estates. The LLS action expanded the eligibility criteria for those impacted by the Stolen Generation policy to include deceased estates, direct carers and siblings.

LLS recognises the current Federal Government’s actions towards reconciliation and the recognition of the injustices of the past. LLS continues to priorities access to justice, with litigation continuing to be an ongoing and valuable impetus for bringing such issues to the fore.
