In considering claims for funding, LLS assesses the claims against the following key criteria:
Legal merits
There should be a strong case on liability. Preferred claims are document-based (rather than relying significantly on oral testimony), primarily involve legal rather than factual disputes, and are supported by senior counsel advice.
Quantum
LLS considers claims with realistic recoverable damages of $1 million and above.
Recoverability
Evidence should be available supporting the defendant’s ability to pay any judgment or settlement amount.
Proportionate costs
Costs must be proportionate with the size of the claim. While individual cases vary, as a general rule of thumb, LLS will fund up to 10% of the estimated recoverable claim size – this ensures allowance is made for the recoveries both to the funder and the claimants, as well as contingencies.
